Mobile Bistros Agreement:
We believe in working with our clients to overcome the challenges that may occur from hosting parties. Feel free to email us to work through any issues before, during and after an event. We will do our best to help you
How it works: We arrive about 1 hour before serving. For a standard 40 pizza serving, we take approximately 2 hours. We need 45 minutes to set down. On average, expect us to be around for 3 – 4 hours with 2 hours cooking. For larger numbers, adjust accordingly.
What we need from you: Creating a portable kitchen and preparing and serving hot food off-site requires planning. We need a clear and safe external space of at least 2.5m x 3m in order to set up and serve. Please ensure that you have a safe space prepared for your chef.
Whilst we can prepare the food, we do need to start cooking once set-up. This is to ensure that the food prepared is safe.
Mostly, guests will visit the food stand and have food cooked to order. Sometimes, particularly for larger numbers, you may have a serving table. If so, please also consider that, if you choose not to have a waiting service, you will need to find willing guests to collect the pizzas and take to your buffet area as we are unable to leave the ovens unattended. You may find that if you ask friends and relatives, they will be more than happy to support you at your event. Children of teen age may find it fun to be involved in collecting the pizzas for you to serve.
We provide sturdy 10″ biodegradable paper plates and napkins with each serving.
And a word on children, pets and safety. The pizza oven we use can reach temperatures of 500C. That’s hot. Where we prepare and cook needs to be a safe place. It is not a suitable area of exploration for young children or pets, or drunken adults, to explore or play. We cannot take responsibility for managing them. It is the full and complete responsibility of the event owner and their guests to keep children and pets away from the cooking area and to keep them safe.
Clean up: We will remove our own pizza preparation rubbish, but can not take party and guest rubbish.
Parking: Client agrees to provide parking near the catering area free of charge.
Booking Process and Cancellation Policy
Remittance: The price you are quoted consists of two key elements. Firstly, the booking fee secures the date exclusively for you. This means that we will refuse requests from others for the same date and time and is, therefore and understandably, a non-refundable booking fee. Whilst the booking fee guarantees your exclusivity, it also represents the fixed costs of a seasonal business. That is to say, that event businesses whilst always open, are not always delivering goods and services. There are employment, marketing, advertising, equipment, management, food hygiene, customer service and other related costs. The booking fee takes these fixed costs into consideration also.
Secondly, the remainder relates to good and services for your event and is payable up to 30 days prior to your event. If payment is not received by this date, we reserve the right to consider the booking date and the booking fee forfeit. All payments are made by card or bank transfer. We don’t accept cash or payments at your event.
Cancellation: Any cancellation forfeits your non-refundable booking fee. Should you cancel more than 30 days before your event, the remaining 50% for goods and services will not be due. Should you cancel within 30 days of your event, the full payment is due. Should you change the details of your booking considerably, such as a change of venue or circumstances which prohibits us from delivering our services, we shall consider this as a cancellation for our purposes. Should Mobile Bistros need to cancel your booking, we will inform you at least 30 days before your event and refund any payment received, as soon as practicably possible. Completion and/or payment of an online booking is not confirmation of a booking. Confirmation that we accept your booking is made subsequently.
COVID-19: Like most businesses, we are monitoring and following official government guidelines with respect to Coronavirus (COVID-19). Current guidance does not affect the small and private gatherings which we typically serve. This may change in the future and we will continue to follow government guidelines. We foresee 3 possible outcomes:
- Government guidance continues to have no official impact on private gatherings. Business as usual.
- Government guidance is updated and impacts the number of guests (such as isolating over 70s). If requested, we will adjust your numbers downwards by up to 15% and refund monies for goods and services where applicable. The minimum of 30 servings applies.
- The vast majority of our parties are held privately at homes. However, should you hire a public venue (community centre for example) and the venue is officially closed, we will refund the booking fee where 7+ days notice is provided. Within 7 days, 50% of the booking fee will be refunded. Proof of the closure will be required such as a social media statement by the venue.
Should you choose to cancel a booking, rather than adjust the number of guests, then this will be considered a personal decision and the standard cancellation terms apply. Your booking fee, which secures your chosen date exclusively for you and means we turn away alternative clients, is non-refundable. The amount paid for goods and services is refundable if cancelled at 30 days or more.
We feel this is a reasonable approach which balances the current advice with the understandable uncertainty of making a booking.
Additionally, there are many options which reduce the need for guests to come into close contact with our team and still enjoy your offering. Pre-orders can also be taken in advance and served in order using a numbering system. Typically, however, hosts prefer to have an informal system of guests visiting the stand to order as and when.
Whilst the current climate is causing uncertainty, it’s perhaps important not to lose sight that for the vast majority of our clients, their friends and families, it is business as usual and parties boost the soul 🙂
Termination:
We may terminate the provision of any part of the services or restrict your access to services without any prior notice to you where (by way of example and without limitation):
a. there is a regulatory or statutory change limiting our ability to provide the services;
b. any event beyond our reasonable control prevents us from continuing to provide the services (for example extreme weather or force majeure including pandemics). In this respect, should the service be unavailable for more than one working day our performance under this agreement is deemed to be suspended for the period that the event in question continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the event to a close or to find a solution by which our obligations under this agreement may be performed despite the event in question;
c. we consider in our reasonable discretion that you are abusing the services provided by us or acting in any way which deliberately jeopardises the service or you are otherwise acting in breach of these terms and conditions and we have notified you of the abuse or breach.
Limitation of liability:
We will only be liable for losses which are foreseeable to both you and to us as a consequence of us breaching these terms of sale and caused by our own negligence. We will not be responsible for any indirect losses (including without limit loss of goodwill, travel or accommodation) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us at the time our contract was formed, or at the time you began using our service.
We exclude, to the extent permitted by law, any express or implied warranties and conditions. Nothing in the foregoing shall limit our liability for death or personal injury or as otherwise required by law. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the website or our Service or to your downloading of any material posted on it, or on any website linked to it.
Indemnity:
You agree to indemnify (and to hold us and any of our officers, employees and agents) from and against all and any expenses, losses, liabilities, damages, costs or expenses incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of the services and/or your breach of these terms and conditions.
